Giftphoria – Terms & Conditions
These Terms & Conditions (hereinafter referred to as the “Terms”) govern the rights and obligations between Emerald Pin s. r. o. (hereinafter “Seller”) and the customer (hereinafter “Buyer”) when purchasing goods through the online store www.giftphoria.eu (hereinafter “Store”). By placing an order, the Buyer confirms that they have read and agree to these Terms.

2.2 Buyer:
A natural or legal person who places an order in the online Store.
2.3 Goods:
Gift packages presented for sale on www.giftphoria.eu
3.1 An order placed by the Buyer through the online Store is considered a proposal to conclude a purchase agreement.
3.2 The purchase agreement is concluded when the Seller sends a binding order confirmation by email.
3.3 The Seller reserves the right to refuse an order for reasons such as unavailability of goods or other objective reasons.
4.1 All prices are in EUR, including VAT, and are valid at the time the order is placed.
4.2 Shipping costs are added to the total order amount and displayed before completing the order.
4.3 Payment can be made via bank transfer or other available online payment methods.
5.1 The Seller undertakes to deliver the ordered goods within Slovakia within the timeframe indicated for the specific product, usually 3–5 business days.
5.2 The delivery period starts from the day the payment is received if prepayment was chosen.
5.3 In case of delays due to reasons beyond the Seller’s control, the Buyer will be informed.
6.1 The Seller is responsible for defects present at the time the Buyer receives the goods and which appear during the warranty period according to applicable legislation.
6.2 The Buyer must check the goods immediately upon delivery and notify the Seller of any defects within 14 days of receipt.
6.3 Complaints must be submitted by email to info@giftphoria.eu
7.1 Due to the nature of the goods (gift packages containing fragile or perishable items), the 14-day right of withdrawal under §7(6) of Act No. 102/2014 Coll. does not apply if the goods were delivered in perfect condition.
7.2 For damaged or incorrect goods, the Buyer may submit a complaint within 24 hours of receipt, including photos of the damage.
7.3 After reviewing the complaint, the Seller may offer a replacement or an appropriate financial compensation.
7.4 Complaints regarding perishable food will be handled individually, taking into account possible handling after delivery.
8.1 The Seller processes the Buyer’s personal data in accordance with Act No. 18/2018 Coll. on the protection of personal data and GDPR (EU) 2016/679.
8.2 Data is used solely for processing orders, invoicing, delivery, and communication regarding complaints.
8.3 Personal data will not be shared with third parties except contractual partners responsible for delivery and payment services, who are bound by data protection obligations.
8.4 The Buyer has the right to access, correct, delete, and restrict the processing of their data. These rights can be exercised via info@giftphoria.eu
8.5 The Buyer has the right to file a complaint with the Office for Personal Data Protection of the Slovak Republic.
9.1 Gift vouchers (“Vouchers”) are available for purchase in the Store and can be used to buy goods on www.giftphoria.eu
9.2 Vouchers are valid for 12 months from the date of purchase and expire afterward.
9.3 Vouchers are non-refundable, cannot be exchanged for cash, and the full value must be used in a single order unless otherwise stated.
9.4 Giftphoria is not responsible for lost or damaged Vouchers.
9.5 Vouchers cannot be used to purchase other vouchers and cannot be combined with other discounts unless explicitly stated.
10.1 Consumer disputes can be addressed via the Slovak Trade Inspection (SOI), Prievozská 32, 827 99 Bratislava 27, www.soi.sk.
10.2 Online dispute resolution is available via the platform at https://ec.europa.eu/consumers/odr/
10.3 The European Consumer Centre Slovakia (https://esc-sr.sk) provides guidance and assistance for disputes under EU Regulation No. 524/2013.
11.1 These Terms are effective from the date of publication on www.giftphoria.eu
11.2 The Seller reserves the right to modify these Terms at any time; the current version will always be available on the website.
11.3 Relations between the Seller and Buyer are governed by the laws of the Slovak Republic.
